What DiscoBeat is
DiscoBeat is an app that makes smart lights from several brands change in time with the music playing in the room, offered by Taylor Addison, an individual ("we"). By using the app, the website or the web app you agree to these terms and to the privacy policy. If you got the app from the App Store or Google Play, that store's standard terms for apps apply as well.
Flashing lights — read this first
Photosensitivity warning. DiscoBeat makes lights change colour and brightness quickly, and can make them flash. A small number of people can have a seizure when exposed to flashing lights or patterns, even with no history of epilepsy. Strobe effects are capped at 3 flashes a second by default; lifting the cap in Settings → Flashing lights shows this warning again first. Do not lift it if you, or anyone who may be in the room, has photosensitive epilepsy or has reacted to flashing light before. Stop at once and seek medical advice if anyone experiences dizziness, altered vision, eye or muscle twitching, loss of awareness, disorientation or any involuntary movement. Use the stop button or turn the lights off at the switch; both end the show immediately.
Your account
You do not need an account to use DiscoBeat. If you create one (to send diagnostics), you need to be 13 or older, or older where the law where you live requires it for agreeing to online services. Keep your password to yourself, and tell us at once if you think the account has been compromised. You can delete it inside the app at any time (Settings → Account → Delete account).
Your lights and your home
DiscoBeat sends commands to lights on your own network, often many times a second. You are responsible for the devices you connect and for using them safely and as their makers intend. DiscoBeat is not made, endorsed or supported by Signify (Philips Hue), Govee, LIFX, Nanoleaf, the WLED project, Twinkly, Yeelight, WiZ or Apple; their names are trademarks of their owners and are used here only to say what the app works with.
Labs. Some brands are available only after you switch them on in the Labs row in Settings, because they are controlled through protocols their makers do not publish. A firmware update can stop a Labs brand working without notice, and we remove any Labs integration its maker asks us to remove. Use Labs at your own risk.
How tightly a light keeps time depends on the light, its firmware and your network. The calibrator measures it and tells you; we do not promise that any particular light will keep time.
Music and what you make
DiscoBeat listens to sound in the room and reads song files you already have; it does not record audio, and it does not access music services. You are responsible for having the right to play the music you play. Shows, cue sheets and calibrations you make are stored on your phone and are yours.
Using the service properly
Do not use DiscoBeat to break the law, to harm or harass anyone, to probe, overload or interfere with our server, or to send it anything other than what the app sends. Do not use it to control lights in a place where flashing or sudden changes of light could endanger someone. We may suspend or close accounts that break these rules.
Availability
DiscoBeat is offered as it is. Finding, calibrating and playing lights all happen on your phone and keep working without our server. We aim to keep the server running but do not promise it will be available at any particular time, and we may change or discontinue features. If we shut the server down we will give at least 30 days' notice in the app.
Payment
DiscoBeat is free to use, with limits. DiscoBeat Pro is a one-time purchase that removes them; there is no subscription. It is sold by the App Store or Google Play under their terms, refunds are handled by them, and a purchase can be restored on a new device signed in to the same store account. Prices are shown in the store before you buy.
Disclaimers and liability
To the fullest extent permitted by law, DiscoBeat is provided without warranties of any kind, and we are not liable for indirect or consequential loss, or for any effect of the app on devices made by others. Our total liability to you is limited to the amount you paid for DiscoBeat in the twelve months before the claim, or 100 US dollars if you paid nothing. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, and nothing here takes away rights you have as a consumer where you live.
Ending it
You can stop using DiscoBeat and delete your account at any time. We can end these terms if you break them; if we do, we will say why unless the law prevents it.
Changes to these terms
When these terms change, the date at the top changes. Material changes are announced inside the app before they take effect; continuing to use the app after that is acceptance.
Governing law
These terms are governed by the law of the State of Georgia, USA, and disputes go to the courts located in Georgia, except where the law where you live gives you the right to bring a claim there.
